Terms of Service & Privacy Policy

1. Who we are and what we provide

Kegon is a service of Kegonix Data Consulting Pty Ltd, an Australian business. We compile information from public government records — federal court dockets, county clerk and recorder systems, state business registries and municipal open-data portals — and deliver it to business subscribers as news alerts and marketing intelligence, by email and file download.

2. Permitted and prohibited uses

Our services are not a "consumer report" and Kegon is not a consumer reporting agency under the U.S. Fair Credit Reporting Act (FCRA). You may not use our data, in whole or in part, to establish any individual's eligibility for credit, insurance, employment, housing, or any other purpose enumerated by the FCRA.

You may not use our data to harass or intimidate any person, or in violation of any applicable law, court rule, or rule of professional conduct — including state bar advertising rules, the Fair Debt Collection Practices Act, CAN-SPAM, and the Telephone Consumer Protection Act. You are solely responsible for the legality of your own outreach.

3. Accuracy and verification

Public records contain errors. We transcribe them without alteration and without warranty of accuracy, completeness, or timeliness. Every record we deliver carries its public source reference; verify at the source before relying on it. Report an error to us and we will correct our copy promptly.

4. Subscriptions, billing and cancellation

Subscriptions are billed monthly in advance in US dollars, processed by Stripe. Card statements show "KEGON". Cancel at any time by replying to any email from us with "stop", or from the billing portal linked in every receipt — cancellation takes effect at the end of the current period and there are no cancellation fees or notice requirements. Subscriptions are paid from the first month; we do not offer free trials.

5. Your data

We collect only what is needed to deliver the service: your name, email address, the feeds you subscribe to, and billing details processed by our payment provider (we never store card numbers). We do not sell subscriber information. Ask us to delete your account and we will do so, along with your data, within 30 days.

6. Our marketing emails

Our own outreach complies with CAN-SPAM: honest subject lines, a valid physical mailing address, and a working opt-out. Opt-outs are added to a permanent suppression list the same day they are received.

7. Individuals appearing in public records

If you appear in a public record we distribute and wish to be excluded from future deliveries, email us and we will suppress your information going forward. We cannot alter or remove the underlying government record, which is maintained by the issuing authority.

8. Limitation of liability

The service is provided "as is". To the maximum extent permitted by law, Kegon' total liability for any claim is limited to the amount you paid us in the three months preceding the claim. We are not liable for business decisions made in reliance on public record data.

9. Governing law and contact

These terms are governed by the laws of New South Wales, Australia, where Kegonix Data Consulting is based. Nothing here limits any right you have under the mandatory consumer or trade-practices law of your own jurisdiction.
